eKadence Inc. (“eKadence,” “we,” “our,” or “us”) is committed to protecting your privacy. This Privacy Policy describes how we collect, use, share, and protect the personal information of users who access our services via https://www.eKadence.com or https://ekadence.org (collectively, the “Site”) and other interactions with eKadence. By using our Site, you acknowledge that your information will be processed in the United States in accordance with this Privacy Policy.

Personal Information
“Personal Information” refers to any data that identifies you as an individual or relates to an identifiable person.

  • For Instructors and Parents: During registration for a free account, we collect First Name, Last Name, and Email. Optional information includes Bio, Gender, Birthday, Phone, and Address.
  • For Learners/Students: We collect First Name, Last Name, Email or Username, and Birthday during registration. Optional information includes Bio, Gender, Phone, and Website.

Note: Schools, districts, or teachers must obtain parental consent for students under 13 before using the Site. Minor students’ personal information is collected only when their institution contracts with eKadence, ensuring this data remains within the educational context.

Other Information
We collect data to improve our services, such as IP addresses, browser types, ISP information, and clickstream data. Tracking technologies (e.g., cookies) help us analyze trends and manage user sessions. This data may be linked to Personal Information and is not shared with third parties outside the scope outlined in this policy.

2. How We Use Your Information

We use the information we collect for various purposes, including:

  • Service Delivery: Providing and maintaining our Platform’s features and tools.
  • User Communication: Sending relevant notices, updates, and service-related information.
  • Analysis and Improvements: Conducting analysis for Platform enhancement and new feature development.
  • Compliance: Ensuring adherence to applicable laws such as FERPA, COPPA, and GDPR.
 
 

3. How We Share Your Information

We share your information in the following ways:

  • With Educational Institutions: Data shared with schools, districts, or teachers for educational purposes.
  • Third-Party Service Providers: We work with trusted third-party services (e.g., Google Analytics) for operational support, ensuring they use the information only as needed for their functions.
    • Google Analytics – Google Analytics is an analytics service used to help analyze your use of our Main Domain and allow us to improve communication. We use the information we get from Google Analytics only to improve our Main Domain. Google Analytics does not share your information with any other third parties.
    • Google Workspace APIs – If your district uses Google Workspace, we connect to Google Workspace APIs to integrate with its suite of products. No data obtained from these APIs are used to develop, improve, or train generalized AI and/or ML models.

  • Legal Requirements: Disclosure may be necessary for legal compliance, to protect our rights, or in response to legal processes.
 
 

4. Compliance with Regulations

FERPA Compliance
eKadence acts as a “school official” under FERPA, using student data solely for educational purposes as directed by institutions. The ownership of student data remains with the educational institution.

COPPA Compliance
For children under 13, parental consent is obtained through the school, district, or teacher. Data collected is limited and used only for educational services.

GDPR Compliance
For EEA users, we comply with GDPR. Data processing is based on legitimate interest or user consent obtained by the institution. EEA users have rights to access, rectify, or erase their data and may request restrictions on processing.

5. Data Security

eKadence employs industry-standard security measures (e.g., SSL encryption) to protect user data. While we strive for secure data handling, no system can guarantee complete safety. Users are encouraged to maintain strong passwords and secure their account credentials.

6. Data Retention

We retain Personal Information as needed for service delivery and legal compliance. Users can request data deletion through their school administrator or by contacting support@eKadence.com.

7. Tracking Technologies

Cookies and LSOs: We use cookies, tags, and LSOs (e.g., Flash, HTML5) for user experience enhancement and analytics. Browsers may provide tools to manage these technologies.

8. Parental Rights

Parents can access, review, or request the deletion of their child’s information by contacting their school administrator or, for free account users, by reaching out to eKadence support.

Parents have the right to refuse the site further contact with their child and to have access to their child’s information and to have it deleted by contacting the school administrator.

Parents have the right to consent to the site’s use of the child’s personal information without having to consent to its disclosure of that information to third parties by contacting the school administrator.

If you are the parent and guardian of a student using eKadence and cease to agree with eKadence’s terms of use and privacy policy at some point in the future, you may opt-out by contacting (a) your Subscriber (typically your school) eKadence administrator if you are an Enterprise account user, or (b) eKadence at support@eKadence.com if you are a basic account user.

If yours or your child’s personally identifiable information changes, or if you no longer desire our service, you may correct, update, or delete it by making the change on our member information page or by contacting Customer Support via @support@eKadence.com. We will respond to your access request within 30 days.

We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services, contact us via support@eKadence.com. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

9. Internet Privacy & Security

eKadence and associated institutions collaborate to protect user data, including students. While we implement encryption and secure systems, perfect security cannot be guaranteed, and users acknowledge this risk.

10. Changes to the Privacy Policy

We reserve the right to modify this Privacy Policy. Updates will be posted on our Site, and significant changes will be communicated through email and on the home page. Parents will be notified if changes impact the collection of children’s data.

11. Disclosure in Business Transfers

In the event of business transfers (e.g., mergers, acquisitions), your information may be transferred as part of business assets. If this happens, we will notify affected users and provide them the opportunity to opt into any new practices.

12. Links to Other Sites

Our Site may link to external sites not operated by us. We are not responsible for their privacy practices. Users should review the privacy policies of any third-party websites they visit.
